These Terms of Service ("Terms") are a legal agreement between you and MyTaek [LEGAL ENTITY TYPE] ("MyTaek," "we," "us," "our"), governing your access to and use of the MyTaek website, web application, mobile application, chatbot, and related services (collectively, the "Service").
PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER FOR USERS LOCATED IN THE UNITED STATES (SECTION 17), WHICH AFFECT YOUR LEGAL RIGHTS. IF YOU ARE A CONSUMER LOCATED IN THE EUROPEAN UNION OR EUROPEAN ECONOMIC AREA, MANDATORY CONSUMER PROTECTION LAWS OF YOUR COUNTRY OF RESIDENCE APPLY NOTWITHSTANDING ANYTHING IN THESE TERMS TO THE CONTRARY.
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
By using the Service you represent and warrant that: you have the legal capacity to enter into a binding contract; you are not barred from using the Service under the laws of your jurisdiction; and all registration information you submit is accurate, current, and complete.
If you register on behalf of a Dojang, martial arts school, or other business entity, you represent that you have the authority to bind that entity to these Terms, and "you" refers to both you individually and that entity.
MyTaek provides a software-as-a-service platform for martial arts schools, including: school and student management tools, parent/guardian portals, progress and belt-rank tracking, scheduling, in-app messaging, payment and billing processing, a conversational assistant ("MyTaek Chatbot"), and gamified engagement features (including the "Dojang Rivals" companion experience). Features vary by subscription tier and may be added, changed, or removed at our discretion.
THE SERVICE IS A SOFTWARE AND ADMINISTRATIVE TOOL. MYTAEK DOES NOT PROVIDE, SUPERVISE, CERTIFY, OR GUARANTEE THE QUALITY, SAFETY, OR OUTCOME OF ANY IN-PERSON MARTIAL ARTS INSTRUCTION. ALL PHYSICAL INSTRUCTION IS PROVIDED SOLELY BY THE INDEPENDENT DOJANG/SCHOOL AND ITS INSTRUCTORS, WHO ARE NOT EMPLOYEES OR AGENTS OF MYTAEK.
The Service supports multiple account roles, including School Owner, Administrator, Coach/Instructor, Parent/Guardian, and Student (managed). Permissions and data visibility differ by role.
You are responsible for: maintaining the confidentiality of your login credentials; all activity that occurs under your account; and notifying us immediately at [SECURITY CONTACT EMAIL] of any unauthorized access.
You agree to provide and maintain accurate, current, and complete account information. We may suspend or terminate accounts containing information we reasonably believe to be false, misleading, or fraudulent.
Access to certain features requires a paid subscription. Current plans, pricing, and included features are described at the pricing page and may vary by region and currency.
Subscriptions are billed in advance on a recurring basis and automatically renew at the then-current rate unless cancelled prior to the renewal date. You authorize us to charge your designated payment method for all applicable fees.
We may change Subscription prices. For existing subscribers, price changes take effect no earlier than the next renewal period following at least [30] days' notice.
Fees are exclusive of applicable taxes (including VAT, sales tax) unless stated otherwise. You are responsible for all such taxes, other than taxes on our net income.
You may cancel your Subscription at any time through account settings or by contacting [SUPPORT EMAIL]. Cancellation takes effect at the end of the then-current billing period.
Except where required by applicable law, fees are non-refundable, including for partial billing periods, unused features, or early cancellation.
Payments are processed by our third-party payment processor, [PAYMENT PROCESSOR]. We do not store full payment card numbers on our own servers.
If you are a consumer resident in the EU/EEA, you have a statutory right to withdraw from a distance contract within 14 days, except that this right is lost once performance has begun with your prior express consent. By activating a Subscription, you expressly request immediate performance and acknowledge the loss of the withdrawal right.
If offered, free trials convert automatically to a paid Subscription at the end of the trial period unless cancelled before the trial ends.
MyTaek acts solely as a technology platform provider and facilitator of transactions between schools/coaches and parents. Coaches and schools are independently and solely responsible for reporting and paying all applicable taxes arising from any premium app revenue earned through the Service.
In the event of a parent payment chargeback or disputed transaction, MyTaek reserves the right to withhold or claw back equivalent funds from the coach or school's associated payout account.
You agree not to, and not to permit any user under your account to:
The Service, including all software, design, text, graphics, logos, and the MyTaek name and marks, is owned by MyTaek or its licensors and is protected by intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service during your Subscription term.
You retain ownership of content you submit ("User Content"). You grant MyTaek a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for technical purposes), and display User Content solely to operate the Service.
If you provide suggestions, ideas, or feedback about the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free right to use it for any purpose without compensation.
We may remove or disable access to any User Content that we reasonably believe violates these Terms or applicable law.
The Service allows coaches to assign video tasks and permits students (including minors) to upload video and photographic footage. The school owner and coaches represent and warrant that they have obtained verifiable, written parental consent and a comprehensive media release form from the parent or legal guardian of every minor student before permitting them to upload content.
MyTaek acts strictly as a passive data processor hosting such content. The school shall fully indemnify and hold harmless MyTaek from any claims arising from the unauthorized recording or publication of minors' activities on the platform.
The Service may integrate with or link to third-party services. We do not control and are not responsible for third-party services, their content, or their privacy/security practices. Your use of third-party services is governed by their own terms.
The Service includes an AI-assisted chatbot and other automated features. You acknowledge that: outputs may be inaccurate, incomplete, or inappropriate and should not be relied upon as professional, medical, safety, or legal advice; MyTaek does not guarantee the accuracy of any automated output; and you are responsible for reviewing and verifying any information before acting upon it.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
MYTAEK IS A SOFTWARE ADMINISTRATION TOOL. IT DOES NOT PROVIDE PHYSICAL INSTRUCTION, MEDICAL ADVICE, FITNESS ADVICE, OR SAFETY SUPERVISION. ANY DECISION TO PARTICIPATE IN MARTIAL ARTS TRAINING IS MADE SOLELY BETWEEN YOU AND THE RELEVANT DOJANG/SCHOOL, AND CARRIES INHERENT RISK OF PHYSICAL INJURY THAT MYTAEK DOES NOT ASSUME OR ACCEPT LIABILITY FOR.
Nothing in this Section limits any liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
MYTAEK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY.
MYTAEK'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (I) THE TOTAL FEES YOU PAID TO MYTAEK IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (II) €100 / $100.
Nothing in this Section excludes or limits liability that cannot be excluded under applicable law, including under mandatory EU/EEA consumer protection law.
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless MyTaek from and against any claims, liabilities, damages, losses, and expenses arising out of or related to: your use or misuse of the Service; your violation of these Terms; your violation of any third-party right; any User Content you submit; or your violation of any applicable law.
You may terminate your account at any time by following the cancellation process in Section 4.5 or by contacting [SUPPORT EMAIL].
We may suspend or terminate your access at any time if we reasonably believe: you have violated these Terms; required by law; continued provision would expose us to legal liability; or your account is delinquent on payment.
Upon termination: your right to access the Service immediately ends; we may delete your account data in accordance with our data retention practices; and provisions that by their nature should survive (including Sections 6, 9, 10, 11, 17, and 18) survive.
Upon termination, MyTaek will preserve your historical student roster and progress data for a strict grace period of thirty (30) calendar days. During this period, the school owner may request a CSV export via Support. After 30 days, all data will be permanently and irreversibly deleted, subject to statutory data preservation requirements.
Our collection and use of personal data is described in our Privacy Policy. Where MyTaek processes personal data on behalf of a School, the School acts as data controller and MyTaek acts as data processor under a separate Data Processing Addendum.
We may modify, suspend, or discontinue any part of the Service at any time. We will use commercially reasonable efforts to provide notice of material adverse changes to paid features.
We may revise these Terms from time to time. If we make material changes, we will provide notice at least [14] days before the changes take effect. Continued use constitutes acceptance. If you do not agree, you must stop using the Service.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any restricted parties list. You agree to comply with all applicable export control and economic sanctions laws.
If you are a consumer habitually resident in the EU, EEA, or UK, these Terms are governed by the laws of [THE NETHERLANDS], without prejudice to any mandatory consumer protection provisions of your country of residence.
For all other users, these Terms are governed by the laws of the State of [DELAWARE / STATE], United States, without regard to its conflict of laws principles, except as modified by Section 17.
This Section does not apply to consumers habitually resident in the EU, EEA, or UK.
You and MyTaek agree that any dispute shall be resolved by binding arbitration, rather than in court, except that either party may bring an individual action in small claims court.
YOU AND MYTAEK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Arbitration shall be administered by [ARBITRATION BODY] under its applicable rules.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to [LEGAL/OPT-OUT EMAIL].
These Terms, together with the Privacy Policy and any order forms or DPAs, constitute the entire agreement between you and MyTaek regarding the Service.
If any provision is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions remain in full force.
Our failure to enforce any right is not a waiver of that right.
You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
We are not liable for any delay or failure to perform resulting from causes outside our reasonable control.
We may provide notices via email, in-app notification, or posting on the Service. Notices to us must be sent to [LEGAL CONTACT EMAIL/ADDRESS].

If you access the MyTaek mobile application through the Apple App Store or Google Play Store, you acknowledge and agree that:
